Litigation, Arbitration and Restructuring
Our litigation department is coordinated by lawyers with 10 to 20 years of experience in litigation and arbitration and consists of 8 litigation lawyers, each of them specialized in our company’s key fields of activity.
Six litigation lawyers from the NZA team have the experience and the right to practice before the High Court of Cassation and Justice. This confirms the NZA policy to increase the quality of services through teams composed mainly of experienced lawyers, with junior lawyers taking up a support role mainly through preliminary analysis and research.
Being aware that any consulting activity involves analysing the resilience of the outcome of a course of action in the event of a possible litigation, all NZA lawyers have and will have backgrounds in litigation practice.
NZA covers the whole range of litigation and services related to litigation: (i) starting with the preliminary phases of risk analysis/ investigation and preparation of strategies and evidence, (ii) continuing with the effective representation in court and ending with (iii) enforcement, including the recognition and enforcement of judgments from foreign jurisdictions, as well as training and assisting clients in insolvency procedures.
In our current activity we represent national and multinational clients:
- before bodies with administrative jurisdictional powers: CNSC, CNCD, the Court of Accounts, the Competition Council etc.,
- within preliminary and alternative dispute resolution procedures: mediation procedures, procedures for dispute adjudication within FIDIC Contracts, ad-hoc arbitrations,
- before courts in various types of litigation: civil, commercial, insolvency and restructuring, administrative court, regarding the awarding and implementation of public procurement contracts, energy, labour law, etc.,
- in institutionalized arbitration, both in front of the Court of International Commercial Arbitration attached to the Chamber of Commerce and Industry of Romania, ICC Paris and in front of other international arbitration courts.
